Rental Agreement
PROP TWINS RENTAL AGREEMENT
IN CONSIDERATION OF the mutual covenants and promises in this Agreement, the receipt and sufficiency of which consideration is hereby acknowledged, Prop Twins rents the Props to the Authorized User, and the Authorized User agrees to the use of the Props from the Prop Twins on the following terms of use:
Definitions
1. The following definitions are used but not otherwise defined in this Agreement:
a. "Prop Twins" is the owner of all property and equipment rented from inventory.
b. "Props" means any items, backdrops, plinths, chiaras or tabletop decor and furniture.
c. "Authorized User is with whom the agreement has been made, paid for by and promised to.
d. "Total Loss" means any loss or damage that is not repairable or that would cost
more to repair than the market value of the Prop.
e. Prop Twins and Authorized User are collectively the "Parties"
2. Prop Twins agrees to provide rented Props to the Authorized User, and the Authorized User agrees to lease the Equipment from the Prop Twins in accordance with the terms set out in this Agreement.
3. The Agreement commences on the day designated for use, is for a term of one day, and may be renewed on a day-to-day basis (the "Term").
Rent and Deposit
4. The rent for the Props, inclusive of sales tax, will be paid prior to the Authorized User taking possession of the Props.
5. A deposit may be required on certain items before taking possession of the Props. The Prop Twins will refund the Deposit to the Authorized User at the end of the Term rovided that the Authorized User has performed all of the Prop Twins' obligations under this Agreement.
Delivery of Equipment
6. The Prop Twins will, deliver the Prop to the Authorized User at the Event Location.
Use of Equipment
7. Use the props carefully and for its intended purpose.
Don't alter, modify or move the equipment without the permission of the owner.
Do not attempt to clean or disinfect the props.
Warranties
8. The Equipment will be in good working order and good condition upon delivery.
>>>>9. The Equipment is of merchantable quality and is fit for the purposes it is ordinarily used.
Loss and Damage
10. To the extent permitted by law, the Authorized User will be responsible for risk of loss, theft, damage or destruction to the Props from any and every cause.
Remedies
>>>>>11. On the occurrence of an Event of Default, the Authorized User will be entitled to pursue any one or more of the following remedies (the "Remedies"):
a. Declare the entire amount of the Rent for the Term immediately due and payable without notice or demand to the Authorized User.
b. Apply the Deposit toward any amount owing to the Lessor.
c. Terminate this Agreement immediately upon written notice to the Lessee.
d. Pursue any other remedy available in law or equity.
Additional Clauses
12. No refunds/credits in any way as soon as the items leave the store.
By signing this you give Prop Twin's permission to charge a damages fee to the card on file, if
prop needs to be replaced.
Entire Agreement
13. This Agreement will constitute the entire agreement between the Parties. Any prior understanding or representation of any kind preceding the date of this Agreement will not be binding on either Party except to the extent incorporated in this Agreement.
General Terms
14. This Agreement may be executed in counterparts. Facsimile signatures are binding and are considered to be original signatures.
15. Time is of the essence in this Agreement.
Notice to Authorized User
16. NOTICE TO THE AUTHORIZED USER: This is a rental agreement. You are not buying the Props. Please read this agreement in its entirety before signing. Do not sign this Agreement before you read it. You are entitled to a completed copy of this Agreement when you sign it.
